1. About the AstraX Education Terms & Conditions
These Terms & Conditions govern the tutoring and related services provided by AstraX Education, including enquiries, enrolment, free trial lessons, one-to-one and small-group online tutoring, scheduling, fees, learning materials, communications and use of our website.
By enrolling a student, booking or participating in a lesson, or otherwise using our services, the parent, guardian or adult student confirms that they have read and agree to these Terms & Conditions.
These Terms & Conditions should be read together with our Privacy Policy and any specific written arrangements provided by AstraX Education in relation to enrolment, fees or tutoring services.
Nothing in these Terms & Conditions is intended to exclude or limit any rights or remedies that cannot lawfully be excluded.
2. Tutoring Services
AstraX Education provides online tutoring services for school students, including one-to-one tutoring, small-group classes, subject support, examination preparation and related academic assistance.
Tutoring services may vary according to the student’s year level, subject, learning needs, tutor availability and the programs offered by AstraX Education at the relevant time.
AstraX Education will make reasonable efforts to provide suitable tutors and learning support; however, no particular tutor, class time, academic result, examination score or educational outcome is guaranteed.
Lesson content, learning resources and teaching approaches may be adjusted where reasonably necessary to suit the student’s progress, curriculum requirements or class circumstances.
3. Enrolment and Class Arrangements
Enrolment is subject to class availability, tutor availability and acceptance by AstraX Education. Submission of an enquiry or enrolment form does not by itself guarantee a place in a class or a particular tutoring schedule.
Parents, guardians or adult students should provide accurate and complete information about the student’s year level, subjects, learning needs and preferred availability so that suitable tutoring arrangements can be considered.
Where appropriate, AstraX Education may contact the parent, guardian or student to discuss learning needs, academic information, preferred lesson times and available tutoring options before confirming enrolment.
A tutoring arrangement is considered confirmed when AstraX Education provides confirmation of the class or lesson schedule and any relevant joining details, including online meeting information where applicable.
One-to-one lesson times may be arranged according to tutor and student availability. Small-group classes generally operate according to an established class schedule and are subject to available places.
4. Fees and Payments
Fees for tutoring services will be communicated to the parent, guardian or adult student before the relevant tutoring arrangement is confirmed. Fees may vary according to the student’s year level, subject, class format and the tutoring option selected.
AstraX Education may offer one-to-one tutoring, small-group tutoring, weekly invoicing, pay-as-you-go arrangements or term-based payment options, depending on the program and availability at the relevant time.
Invoices must be paid by the due date stated on the invoice. Parents, guardians or adult students are responsible for ensuring that payment details and billing information provided to AstraX Education are accurate and up to date.
Where a prepaid, term or discounted payment option is offered, any applicable conditions will be communicated before payment is made.
If an account remains unpaid after the due date, AstraX Education may contact the responsible payer and may suspend or postpone future lessons until the outstanding amount is resolved.
AstraX Education may review its fees from time to time. Any change affecting an existing tutoring arrangement will be communicated before the revised fee takes effect.
5. Free Trial Lessons
AstraX Education may offer a complimentary trial lesson to eligible new students so that the student and parent or guardian can experience our tutoring approach before deciding whether to continue with paid lessons.
Free trial lessons are subject to tutor availability, scheduling and confirmation by AstraX Education. Submission of an enquiry or request for a trial lesson does not guarantee that a particular tutor, subject, date or time will be available.
Unless otherwise advised, a free trial lesson is provided without charge to the parent or guardian and does not create any obligation to enrol in ongoing tutoring.
The format, tutor and content of a trial lesson may differ from any subsequent tutoring arrangement, depending on the student’s learning needs and available classes.
AstraX Education reserves the right to limit free trial lessons to genuine prospective students and may decline or withdraw a trial offer where reasonably necessary.
6. Cancellations and Rescheduling
One-to-one lessons may be rescheduled where at least 24 hours’ notice is provided, subject to tutor availability and confirmation by AstraX Education.
Requests made with less than 24 hours’ notice may not be able to be accommodated. Any credit, replacement lesson or other arrangement will depend on the circumstances and the applicable tutoring arrangement.
Small-group classes generally operate at fixed scheduled times. Individual students may not be able to reschedule a group lesson they are unable to attend.
If AstraX Education or the assigned tutor needs to cancel or change a confirmed lesson, reasonable efforts will be made to provide notice and arrange an alternative time, replacement lesson or other appropriate solution.
Repeated cancellations, non-attendance or scheduling difficulties may result in the tutoring arrangement being reviewed.
7. Tutor and Class Availability
AstraX Education will make reasonable efforts to provide suitable tutors and maintain consistent tutoring arrangements wherever practicable.
Tutor allocation and class availability may depend on the student’s subject, year level, preferred schedule, learning needs and available teaching resources.
While continuity with the same tutor is preferred, AstraX Education cannot guarantee that a particular tutor will remain available for every lesson or throughout the entire period of enrolment.
Where a tutor becomes unavailable, AstraX Education may offer another suitable tutor, an alternative class time or another reasonable arrangement.
8. Student Conduct and Academic Integrity
Students are expected to participate respectfully and appropriately in tutoring sessions and to communicate with tutors, staff and other students in a courteous manner.
AstraX Education provides tutoring, explanation, guidance, practice and feedback to support genuine learning. Our services are not intended to complete examinations, assignments or assessed work dishonestly on behalf of a student.
Students remain responsible for complying with the academic integrity, assessment and conduct requirements of their school or educational institution.
AstraX Education may refuse, suspend or discontinue a tutoring arrangement where there is serious or repeated inappropriate behaviour, misuse of services, academic misconduct or conduct that adversely affects tutors or other students.
9. Online Class Requirements
Online tutoring requires access to a suitable internet connection, compatible device and any software or platform reasonably required for the lesson.
Students should join confirmed online lessons on time and, where reasonably possible, participate from a quiet and appropriate learning environment.
Parents, guardians and students are responsible for maintaining their own internet service, device, audio, video and other equipment required to access online lessons.
AstraX Education is not responsible for interruptions caused by a student’s internet connection, device failure or other technical issues outside our reasonable control.
Where a significant technical issue affects AstraX Education’s ability to deliver a lesson, we will seek to make a reasonable alternative arrangement.
10. Learning Materials and Intellectual Property
Learning materials, worksheets, presentations, lesson resources, recordings where applicable, website content and other educational materials provided by AstraX Education may be protected by copyright or other intellectual property rights.
Unless otherwise stated, materials provided to a student are for that student’s personal educational use only.
Materials must not be reproduced, published, sold, distributed, uploaded publicly or used for commercial purposes without prior permission from AstraX Education or the relevant rights holder.
Students may retain personal notes and legitimately supplied learning materials for their own study.
11. Parent, Guardian and Student Responsibilities
Parents, guardians and adult students are responsible for providing accurate information relevant to enrolment, communication, scheduling and tutoring arrangements.
They should notify AstraX Education of material changes that may affect lessons, including contact details, availability or relevant learning requirements.
Students are expected to attend lessons prepared to participate and to complete reasonable learning activities or practice tasks where these form part of the tutoring program.
Parents or guardians remain responsible for appropriate supervision and the student’s general welfare while the student participates in online tutoring from home or another location.
12. Privacy
AstraX Education handles personal information relating to students, parents, guardians, tutors and users of our services in accordance with our Privacy Policy.
Personal information may be collected and used for purposes including enrolment, tutoring arrangements, communications, scheduling, billing, progress monitoring and administration.
Our Privacy Policy should be read together with these Terms & Conditions.
13. Changes to Services
AstraX Education may reasonably modify class schedules, teaching arrangements, learning resources, tutors, programs or administrative processes where necessary to maintain or improve its services.
Where a change materially affects an existing tutoring arrangement, AstraX Education will seek to communicate the change within a reasonable period.
The availability of particular subjects, tutors, classes, promotions or payment options may change from time to time.
14. Suspension or Termination of Services
A parent, guardian or adult student may request to discontinue tutoring by contacting AstraX Education.
AstraX Education may suspend or discontinue services where reasonably necessary, including in circumstances involving unpaid fees, repeated non-attendance, serious misconduct, misuse of services or circumstances that prevent the tutoring arrangement from continuing effectively.
Where reasonably practicable, AstraX Education will communicate with the parent, guardian or adult student before terminating an ongoing tutoring arrangement.
Any outstanding fees or other obligations accrued before termination remain payable where applicable.
15. Results, Liability and Consumer Rights
AstraX Education aims to provide structured, appropriate and supportive tutoring; however, academic performance depends on many factors, including student participation, attendance, effort, prior knowledge, school requirements and individual circumstances.
Accordingly, AstraX Education does not guarantee any particular academic mark, examination result, school placement, ATAR, Band result or other educational outcome.
To the extent permitted by law, AstraX Education is not responsible for indirect or consequential loss arising from circumstances beyond our reasonable control.
Nothing in these Terms & Conditions excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under applicable Australian law.
16. Governing Law
These Terms & Conditions are governed by the laws applicable in New South Wales, Australia.
Any dispute relating to these Terms & Conditions or the services provided by AstraX Education will be dealt with in accordance with applicable Australian law and, where appropriate, the courts or tribunals having jurisdiction in New South Wales.
